These Terms of Service (“Terms”) govern your access to and use of Deposit Heroes’ software as a service (SaaS) platform, website, and any other services provided (collectively, the “Service”). By accessing or using the Service, you agree to these Terms. Please read them carefully.
By using the Service, you agree to be bound by these Terms, as well as our Privacy Policy. If you do not agree to these Terms, you may not use the Service.
We reserve the right to modify these Terms at any time. We will notify you of significant changes, but it is your responsibility to review the Terms periodically. Continued use of the Service after any changes indicates your acceptance of the updated Terms.
Registration: To use certain features of the Service, you may be required to register an account. You must provide accurate and up-to-date information during the registration process.
Responsibility: You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.
Deposit Heroes provides a SaaS tool to assist users with the recovery of their contractual security deposits as per their lease agreements.
License: We grant you a non-exclusive, non-transferable, limited license to access and use the Service for your own personal or business purposes.

Ownership of Data: By using the Service, you grant Deposit Heroes full and irrevocable rights to store, use, modify, reproduce, distribute, and create derivative works from your data, including any content, materials, and information you provide or generate while using the Service. This license is granted perpetually, worldwide, and is fully transferable.
Data Retention: We reserve the right to store your data indefinitely, even after you discontinue using the Service.
Third-Party Access: We may share your data with third parties for purposes that include, but are not limited to, improving our services, marketing, analytics, or other commercial purposes.
Service Content: All content provided as part of the Service, including but not limited to software, designs, logos, and trademarks, are owned by Deposit Heroes or our licensors. You may not use any content from the Service without our explicit permission.
User Content: You retain ownership of any content you upload to the Service, but you grant Deposit Heroes a perpetual, non-exclusive, royalty-free license to use, modify, distribute, and display your content in connection with the operation of the Service.
The Services and its entire contents, features, and functionality (including but not limited to all information, software, text, displays, images, video, and audio, and the design, selection, and arrangement thereof) are owned by Deposit Heroes, its licensors, or other providers of such material and are protected by United States and international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.
Payment for the Service is due upfront on a per-case basis. You agree to pay the applicable fees for each case at the time of use. Payment for Services must be made via the methods provided on our platform. All fees are exclusive of applicable taxes, which will be charged as required.
Changes in Pricing: We reserve the right to change our fees at any time, and we will notify you of any changes before you engage with the Service for a new case.
Refund Policy: Refunds are provided equal to 100% of the service fee if the case is heard in the appropriate local small claims court and a verdict is reached that results in less than 100% recovery of the user's contractual security deposit per their lease agreement.
By You: You may stop using the Service at any time by deactivating your account.
By Us: We may suspend or terminate your access to the Service at any time for any reason, including but not limited to, violations of these Terms or inactivity. Upon termination, your access to the Service will be revoked, but we will retain your data as outlined in Section 5.
To the fullest extent permitted by law, Deposit Heroes, its officers, directors, employees, and agents, will not be liable for any indirect, incidental, consequential, or punitive damages, including loss of data, use, goodwill, or other intangible losses resulting from:
Deposit Heroes uses publicly available datasets to provide our services. While we strive to ensure the accuracy and completeness of our data, we do not assert 100% accuracy of our analytics. Our services and tools are designed to assist users in recovering their contractual security deposits, but we do not provide recommendations or legal opinions. Additionally, Deposit Heroes utilizes artificial intelligence (AI) in the provision of our services. While AI can be a powerful tool, it is not infallible and may not always provide perfect results. Users should not rely on the outputs of our AI for making decisions related to their legal matters.
Deposit Heroes is not your lawyer. No attorney-client relationship is formed with any employee or agent of Deposit Heroes. Deposit Heroes does not assess or comment on the merits of your case and does not apply the facts of your case to the law. Deposit Heroes exercises no legal judgment.
You agree to indemnify and hold harmless Deposit Heroes, its affiliates, and their respective officers, employees, and agents from and against any claims, liabilities, damages, losses, or expenses arising from your use of the Service or violation of these Terms.
The Service is provided "as is" and "as available," without warranties of any kind, either express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, or non-infringement.
These Terms will be governed by and construed in accordance with the laws of Florida, without regard to its conflict of law principles. Any legal actions related to these Terms or the Service shall be brought exclusively in the courts located in Miami, Florida.
Any disputes arising out of or relating to these Terms or the Service will be resolved through binding arbitration. The arbitration will be held in Miami-Dade County, Florida.
Entire Agreement: These Terms, together with our Privacy Policy, constitute the entire agreement between you and Deposit Heroes.
Waiver: Any failure by Deposit Heroes to enforce any right or provision of these Terms does not constitute a waiver of such right or provision.
Severability: If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will continue to be valid and enforceable.
